Terms of Service

1. Introduction

This Terms of Service agreement including our Privacy Policy, any other rules and conditions incorporated herein by reference, or provided on the Website (the "Agreement" or "Terms") should be read by you (the "User" or "you" or "your") in its entirety prior to your use of Highcard Software's service or products. Please note that the Agreement constitutes a legally binding agreement between you and Highcard Software SRL (referred to herein as "Blockchain Poker", "us", "our" or "we") which owns and operates the Blockchain Poker website found at blockchain.poker (the "Website") and Blockchain Poker's games or other services or products (the Website and games together, the "Service"). This Agreement and the documents referred to herein apply to the use of the Service. Blockchain Poker's Service is owned by Highcard Software S.R.L., a company registered in Costa Rica and is licensed in the State of Anjouan under the Computer Gaming Licensing Act 007 of 2005.

You should carefully review this Agreement as it contains important information concerning your rights and obligations concerning the use of the Service and form a binding legal agreement between you and us. By using and/or accessing the Service, you, whether you are a guest or a registered user with a Service account (an "Account"), agree to be bound by this Agreement, together with any amendments, which may be published from time to time. Without limiting our other remedies, we may suspend or terminate your Account and refuse to continue to provide you with the Service, in either case without giving you prior notice, if, in our reasonable opinion, you breach any provision of this Agreement or for any other reason at our sole discretion.

If you do not accept and agree to abide by the terms of this Agreement, you must not access or use the Service.

BY CLICKING THE "I AGREE" BUTTON, IF AND WHERE PROVIDED AND/OR ACCESSING OR USING THE SERVICE, YOU CONSENT TO THE TERMS AND CONDITIONS SET FORTH IN THIS AGREEMENT.

2. General Terms

2.1. We reserve the right to update, revise, and amend this Agreement (including any documents referred to and linked to below) at any time. Any amendments will be binding and effective immediately upon publication on the Website. You should visit this page periodically to review the Agreement. If you object to any such changes, you must immediately stop using the Service.

2.2. Your continued use of the Website following such publication will indicate your agreement to be bound by the Agreement as amended. Any bets not settled prior to the changed Agreement taking effect will be subject to the pre-existing Terms. Therefore, we encourage you to check the terms and conditions contained in the version of the Agreement in force at such time.

3. Grant of License

3.1. Subject to the terms and conditions contained herein, Blockchain Poker grants the User a limited, non-exclusive, personal, non-sublicensable, non-transferable right to use/access the Service on your personal computer or other device. Except as expressly provided in this Agreement, we and our licensors do not grant you any express or implied rights, license, title or interest in or to the Service or our Intellectual Property Rights and all such rights, license, title and interest specifically retained by us and our licensors. You agree not to use any automatic or manual device to monitor or copy web pages or content within the Service. Any unauthorized use or reproduction may result in legal action being taken against you.

3.2. Subject to these Terms and your compliance with them, we grant to you a non-exclusive, limited, revocable non-transferable, and non-sublicensable license to access and use the Service for your personal non-commercial purposes only. Our license to you terminates if our agreement with you under these Terms ends.

3.3. Save in respect of your own content, you may not under any circumstances modify, publish, transmit, transfer, sell, reproduce, upload, post, distribute, perform, display, create derivative works from, or in any other manner exploit, the Service and/or any of the content thereon or the software contained therein, except as we expressly permit in these Terms or otherwise on the Website.

3.4. You are not permitted to modify copies of any materials from the Website/App nor delete or alter any copyright, trademark, or other proprietary rights notices from copies of materials from the Website. You must not access or use for any commercial purposes any part of the Services.

3.5. Any non-compliance by you with this Clause may also be a violation of our or third parties' intellectual property and other proprietary rights which may subject you to civil liability and/or criminal prosecution.

4. Prohibited Use

4.1. You must not, and you agree that you will not, use the Service:

• If you are under the age of 18 years (or below the age of majority as stipulated in the laws of the jurisdiction applicable to you) or if you are not legally able to enter into a binding legal agreement with us or you acting as an agent for, or otherwise on behalf, of a person under 18 years.
• If you have made one or more direct account deposits AND are accessing the Service from a country in which access to online gambling to its residents or to any person within such country is prohibited.
• If you have made one or more direct account deposits AND are accessing the Service from one of the following countries: Austria, France and its territories, Germany, Netherlands and its territories, Spain, Union of Comoros, United Kingdom, USA and its territories, Canada, All FATF Blacklisted countries, any other jurisdictions deemed prohibited by Anjouan Offshore Financial Authority.
• To collect nicknames, e-mail addresses and/or other information of other Service users by any means.
• To disrupt or unduly affect or influence the activities of Other Users or the operation of the Service generally.
• To promote unsolicited commercial advertisements, affiliate links, and other forms of solicitation which may be removed from the Service without notice.
• In any way which, in our reasonable opinion, could be considered as an attempt to cheat the Service or Other Users, or collude with any Other Users in order to obtain a dishonest advantage.
• To scrape our odds or violate any of our Intellectual Property Rights.
• For any unlawful activity whatsoever.

4.2. You cannot sell or transfer your Account to third parties, nor can you acquire an Account from a third party.

4.3. You may not, in any manner, transfer funds between Accounts.

4.4. We may immediately terminate your Account upon written notice to you if you use the Service for unauthorised purposes.

4.5. Employees of Blockchain Poker, its licensees, distributors, wholesalers, subsidiaries, advertising, promotional or other agencies, media partners, contractors, retailers and members of the immediate families of each are NOT allowed to use the Service for real money without prior consent from Blockchain Poker's Director or CEO.

4.6. When placing bets, you must not use any information obtained in breach of any legislation in force in the country in which you were when the bet was placed.

4.7. You must not either attempt to manipulate any market or element within the Service in bad faith or in a manner that adversely affects the integrity of the Service or us.

4.8. You must not use your personal profile for your own commercial gain.

4.9. When selecting a nickname for your Account we reserve the right to remove or reclaim it if we believe it appropriate.

4.10. You may not use our URL, trademarks, trade names and/or trade dress, logos, and/or our odds in connection with any product or service that is not ours.

4.11. Additionally, you are strictly prohibited from: impersonating any person or entity; engaging in any unauthorized commercial use of the Service; reverse engineering, decompiling, or disassembling the Service; or interfering with, circumventing, or tampering with any security-related features of the Service.

5. Your Obligations

5.1. You acknowledge that at all times when accessing or using the Service:

• The Service is not for use by individuals under 18 years of age or under the legal age at which gambling activities are lawful in their jurisdiction. It is the User's responsibility to ensure that their use of the Service is lawful.
• You are of legal capacity and can enter into a binding legal agreement with us.
• You are a resident in a jurisdiction that allows gambling and is not one of the Prohibited Jurisdictions.
• You are the authorized user of the payment method you use.
• You must make all payments to us in good faith and not attempt to reverse a payment made.
• When placing bets, you may lose some or all of your money deposited to the Service and you will be fully responsible for that loss.
• You are not acting on behalf of another party or for any commercial purposes, but solely on your own behalf as a private individual in a personal capacity.

6. Intellectual Property Rights

6.1. The term "Blockchain Poker," its domain names, and any other trademarks or service marks used by Blockchain Poker as part of the Service are solely owned by Blockchain Poker. All content on the website, including but not limited to images, pictures, graphics, photographs, animations, videos, music, audio, and text, and any other intellectual property, belongs to Blockchain Poker or is licensed for use by a third party and is protected by copyright and/or other intellectual property rights.

6.2. You hereby acknowledge that by using the Service, you obtain no rights in the Intellectual Property Rights, including no rights in the Site Content and/or the Trademarks, or any part thereof.

6.3. You agree that any unauthorised use of our name and logo or any other violation of our Intellectual Property Rights may result in legal action being taken against you.

6.4. Blockchain Poker and its licensors are the sole holders of all rights in and to the Service and code, structure and organization, technology, software, and business systems including copyright, trade secrets, intellectual property and other rights.

7. Registration

7.1. You agree that at all times when using the Service you will comply with these Terms.

7.2. We reserve the right to refuse to accept a registration application from any applicant at our sole discretion and without any obligation to communicate a specific reason.

7.3. Before using the Service, you must read and accept these Terms. In order to start betting on the Service or withdraw your winnings, we may require you to become a verified Customer which includes passing certain checks. You may be required to provide a valid proof of identification and any other document as it may be deemed necessary.

7.4. You have to provide accurate contact information, inclusive of a valid email address, and update such information in the future to keep it accurate. It is your responsibility to keep your contact details up to date on your Account.

7.5. In order to ensure your financial worthiness and to confirm your identity, we may ask you to provide us with additional personal information, such as your name and surname, or use any third-party information providers we consider necessary.

7.6. You must keep your password for the Service confidential. We advise you to change your password on a regular basis and never disclose it to any third party.

7.7. You must not at any time transmit any content or other information on the Service to another Customer or any other party by way of a screen capture (or other similar method).

7.8. When registering, you will receive the possibility to use all currencies available on the Website.

7.9. We are under no obligation to open an Account for you and our Website sign-up page is merely an invitation to treat.

7.10. Upon receipt of your application, we may be in touch to request further information and/or documentation from you in order for us to comply with our regulatory and legal obligations.

8. Your Account

8.1. Accounts could use several currencies; in this case all Account balances and transactions appear in the currency used for the transaction.

8.2. We do not give credit for the use of the Service.

8.3. We may close or suspend an Account if you are not or we reasonably believe that you are not complying with these Terms, or to ensure the integrity or fairness of the Service.

8.4. We reserve the right to close or suspend any Account without prior notice and return all funds. Contractual obligations already matured will however be honoured.

8.5. We reserve the right to refuse, restrict, cancel or limit any wager at any time for whatever reason.

8.6. If any amount is mistakenly credited to your Account, it remains our property and when we become aware of any such mistake, we shall notify you and the amount will be withdrawn from your Account.

8.7. If, for any reason, your Account goes overdrawn, you shall be in debt to us for the amount overdrawn.

8.8. You must inform us as soon as you become aware of any errors with respect to your Account.

8.9. Please remember that betting is purely for entertainment and pleasure and you should stop as soon as it stops being fun. Absolutely do not bet anything you can't afford to lose. If you feel that you may have lost control of your gambling, we offer a self-exclusion option. Just send a message to our Customer Support Department using your Registered Email Address that you wish to SELF-EXCLUDE and this request will take effect within 24 hours.

8.10. You cannot transfer, sell, or pledge Your Account to another person.

8.11. Should you wish to close your account with us, please send an email from your Registered Email Address to our Customer Support Department via the links on the Website.

9. Deposit of Funds

9.1. All deposits should be made from an account or payment system or credit card that is registered in your own name, and any deposits made in any other currency will be converted using the daily exchange rate.

9.2. Fees and charges may apply to customer deposits and withdrawals. When making deposits to your own account, you are responsible for paying any applicable transaction fees charged by the payment network or processor.

9.3. Company is not a financial institution and uses a third-party electronic payment processors to process credit and debit card deposits; they are not processed directly by us.

9.4. For cryptocurrency deposits, the following confirmation requirements apply before funds are credited to your Account:

• BTC: Deposits require at least one network confirmation before being credited and available for play.
• BCH: Deposits are credited instantly and available for play; however, we reserve the right to change this policy if abuse or double-spend attempts are detected.
• XEC: Deposits are credited instantly and are secured by avalanche pre-consensus.
• Other cryptocurrencies: Deposits processed via SideShift.ai or similar services are credited when the transaction is confirmed by us.
• We reserve the right to delay or reverse credits in the event of suspected double-spend attempts or network anomalies.

9.5. You agree to fully pay any and all payments and charges due to us or to payment providers in connection with your use of the Service. You further agree not to make any charge-backs or renounce or cancel or otherwise reverse any of your deposits.

9.6. If you decide to accept any of our promotional or bonus offer(s) by entering a bonus code during deposit, you agree to the Terms of Bonuses and terms of each specific bonus.

9.7. Funds originating from criminal and/or illegal and/or unauthorized activities must not be deposited with us.

9.8. If you deposit using your credit card, it is recommended that you retain a copy of Transaction Records and a copy of these Terms.

9.9. Internet Gambling may be illegal in the jurisdiction in which you are located; if so, you are not authorized to use your payment card to deposit on this site.

10. No Warranties

10.1. YOU UNDERSTAND AND AGREE THAT YOUR USE OF THE WEBSITE, ITS CONTENTS AND OUR SERVICES OR ITEMS FOUND OR ATTAINED THROUGH THE WEBSITE/APP IS AT YOUR OWN RISK. THE APP/WEBSITE, ITS CONTENT, AND SERVICES OR ITEMS FOUND OR ATTAINED THROUGH THE APP/WEBSITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10.2. NEITHER THE COMPANY NOR ITS PARENT, SUBSIDIARIES, AFFILIATES, OR THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SERVICE PROVIDERS, CONTRACTORS, LICENSORS, LICENSEES, SUPPLIERS, OR SUCCESSORS MAKE ANY WARRANTY, REPRESENTATION, OR ENDORSEMENT WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, SUITABILITY, ACCURACY, CURRENCY, OR AVAILABILITY OF THE WEBSITE OR ITS CONTENTS.

10.3. WE CANNOT AND DO NOT GUARANTEE OR WARRANT THAT FILES OR DATA AVAILABLE FOR DOWNLOADING FROM THE INTERNET OR THE APP/WEBSITE WILL BE FREE OF VIRUSES OR OTHER DESTRUCTIVE CODE. YOU ARE SOLELY AND ENTIRELY RESPONSIBLE FOR YOUR USE OF OUR SERVICES AND YOUR DEVICE, INTERNET, AND DATA SECURITY.

11. Withdrawal of Funds

11.1. You may withdraw any unutilized and cleared funds held in your player account by submitting a withdrawal request in accordance with our withdrawal conditions.

11.2. Transaction fees may apply to withdrawals, depending on the currency and withdrawal method selected. For certain currencies, such as Bitcoin (BTC), we do not currently charge a withdrawal transaction fee.

11.3. We reserve the right to freeze funds or delay withdrawals from accounts that, in our reasonable opinion, are engaged in substantial deposit and withdrawal transactions without a reasonable level of play.

11.4. We reserve the right to request photo ID, address confirmation or perform additional verification procedures for the purpose of identity verification prior to granting any withdrawals from your Account.

11.5. All withdrawals must be made in supported cryptocurrencies, either directly to your designated cryptocurrency wallet or, where available, via third-party services such as SideShift.ai.

11.6. Should you wish to withdraw funds, but your account is either inaccessible, dormant, locked or closed, please contact our Customer Service Department.

11.7. Please note that we cannot guarantee successful processing of withdrawals or refunds in the event if you breach the restricted use obligations stated in Clauses 3 and 4.

12. Payment Transactions and Processors

12.1. You are fully responsible for paying all monies owed to us. You must make all payments to us in good faith and not attempt to reverse a payment made or take any action which will cause such payment to be reversed by a third party. We reserve the right to impose an administration fee of €50, or currency equivalent, per charge-back, denial or reversal of payment you make.

12.2. Any attempt to perform a double-spend or otherwise reverse a transaction after funds have been credited to your Account will be treated as a breach of these Terms.

12.3. We reserve the right to use third party electronic payment processors and/or merchant banks to process payments made by you.

12.4. All transactions made on our site might be checked to prevent money laundering or terrorism financing activity. Suspicious transactions will be reported to the relevant authority.

13. Authority / Terms of Service

Blockchain Poker retains authority over the issuing, maintenance, and closing of the Service. The decision of Blockchain Poker's management, as regards any use of the Service, or dispute resolution, is final and shall not be open to review or appeal.

14. Breach

14.1. Without prejudice to any other rights, if a User breaches in whole or in part any provision contained herein, Blockchain Poker reserves the right to take such action as it sees fit, including terminating this Agreement or any other agreement in place with the User and/or taking legal action against such User.

14.2. You agree to fully indemnify, defend and hold harmless Blockchain Poker and its shareholders, directors, officers, agents and employees from and against any and all claims, demands, liabilities, damages, losses, costs, and expenses, howsoever caused, that may arise as a result of: (i) your breach of this Agreement, in whole or in part; (ii) violation by you of any law or any third party rights; and (iii) your use of the Service.

15. Privacy

By using the Service, you acknowledge and agree that you have read, understood, and accepted our Privacy Policy, which is hereby incorporated by reference into these Terms of Service. You further consent to the collection, use, transfer, and processing of your personal data as described in the Privacy Policy. By using this Website, you are consenting to the use of cookies which allow a server to recall previous requests or registration and/or IP addresses to analyze use patterns.

16. Limitation of Liability

16.1. EXCEPT WHERE SUCH EXCLUSIONS ARE PROHIBITED BY LAW, UNDER NO CIRCUMSTANCE WILL THE COMPANY NOR ITS PARENT, SUBSIDIARIES, AFFILIATES OR THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SERVICE PROVIDERS, CONTRACTORS, LICENSORS, LICENSEES, SUPPLIERS, OR SUCCESSORS BE LIABLE FOR NEGLIGENCE, GROSS NEGLIGENCE, NEGLIGENT MISREPRESENTATION, FUNDAMENTAL BREACH, DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

16.2. TO THE EXTENT PERMISSIBLE BY LAW, IF YOU USE OUR SERVICES FOR ANY COMMERCIAL OR BUSINESS PURPOSE WE WILL HAVE NO LIABILITY TO YOU FOR ANY LOSS OF PROFIT, LOSS OF BUSINESS, BUSINESS INTERRUPTION, LOSS OF BUSINESS OPPORTUNITY OR SIMILAR.

16.3. We will not be liable for any loss or damage caused by a virus, or other technological issues or attacks or harmful material that may infect your computer equipment.

16.4. To the fullest extent permitted by law, you agree that Blockchain Poker and its affiliates shall have no responsibility or liability for any disputes, claims, or damages arising out of or related to interactions or disputes between users.

16.5. Our Website may contain links to third-party websites or resources. Blockchain Poker does not control and is not responsible for the content, privacy policies, or practices of any third-party websites or resources.

16.6. In no event will we be liable or responsible to you, or be deemed to have defaulted under or breached this Agreement, for any failure or delay in fulfilling or performing any term of this Agreement when and to the extent that such failure or delay is caused by any circumstances beyond our reasonable control, including acts of God, flood, fire, earthquake, pandemic, epidemic, war, terrorism, or national emergency.

17. Disputes

If you wish to make a complaint, you can contact the customer support team via the 'support' form on the Website or by sending an email to support@blockchain.poker.

18. Severability

If any provision of this Agreement is found to be illegal, invalid, or unenforceable in any jurisdiction, it will not affect the validity or enforceability of any other provision in that or any other jurisdiction.

19. Assignment

Blockchain Poker may assign this Agreement at any time without notice. You may not assign your rights or obligations without our prior written consent, which we may withhold at our discretion.

20. Cheating

It is a violation of this Agreement to: (i) access the Service from multiple accounts concurrently; (ii) access the Service while running any software which plays without human intervention; (iii) communicate with another player at the same table through a channel other than the provided chat function; (iv) intentionally lose a hand in order to deliberately transfer chips to another player; or (v) leverage any known or unknown exploits that may give the player an unfair advantage in play. Blockchain Poker reserves the right to permanently revoke access to accounts caught in violation of these rules.

21. Abuse

Abusing the Service as well as abusing players/Other users using the Service is strictly prohibited.

21.1. Blockchain Poker reserves the right to revoke access to accounts of players caught repeatedly harassing others.

21.2. Players caught repeatedly abusing the Blockchain Poker faucet in order to increase their player balance without legitimate play will be subject to a permanent ban. Blockchain Poker may, in response to a court order, subpoena, or other lawful demand, provide player information to requesting authorities in cases of suspected criminal misconduct.

22. Account Funding

All account fundings are considered to be purchases of Blockchain Poker Credits. Blockchain Poker Credits are NOT cryptocurrencies and exist solely for the purposes of purchasing tournament tickets and playing poker and other games with other users. Any notation of $, BTC, BCH, or XEC refers to an equivalent unit in Blockchain Poker Credits.

23. Forfeiture & Account Closure

WE RESERVE THE RIGHT, IN OUR UNFETTERED DISCRETION, TO TERMINATE THESE AGREEMENTS, WITHHOLD YOUR ACCOUNT BALANCE, SUSPEND YOUR ACCOUNT, AND RECOVER FROM SUCH ACCOUNT THE AMOUNT OF ANY AFFECTED PAY-OUTS, BONUSES AND WINNINGS IF: (i) You are in breach of any provision of this Agreement, or (ii) We have reasonable suspicion that you are in breach of sections 20 or 21, or (iii) We become aware that You have used or attempted to use the Service for the purposes of fraud, collusion, or unlawful or improper activity.

24. Errors

24.1. You must inform Us as soon as You become aware of any errors with respect to Your Account or any calculations with respect to any bet You have placed or any currency conversion. In the event of such error or any system failure or game error, We will seek to place all parties directly affected by such Error in the position they were in before the Error occurred.

24.2. In the event of an error or malfunction of our system or processes, all bets are rendered void. You are under an obligation to inform us immediately as soon as you become aware of any error with the Service.

24.3. We make every effort to ensure that we do not make errors in posting lines. However, if as a result of human error or system problems a bet is accepted at an odd that is materially different from those available in the general market at the time the bet was made, we reserve the right to cancel or void that wager.

24.4. We have the right to recover from you any amount overpaid and to adjust your Account to rectify any mistake.

25. User-Generated Content

25.1. You may upload or otherwise contribute content for the purposes of both normal play and game sponsorship on the Service. By posting your User Content, you grant us an unrestricted, unlimited, irrevocable, perpetual, non-exclusive, royalty-free, fully-paid, transferable, worldwide right and license to exploit, host, use, copy, reproduce, disclose, sell, publish, broadcast, publicly perform, publicly display, reformat, translate, transmit, and distribute such User Content for any purpose.

25.2. You promise that, with respect to any User Content you post on the Service, (1) you own or have the right to post such User Content, and (2) such User Content does not violate the Agreements or any other rights set forth within applicable law, or the intellectual property, publicity, personality, or other rights of others.

25.3. The Service may, but has no obligation to, monitor, review, or edit User Content. In all cases, the Service reserves the right to remove or disable access to any User Content for any or no reason.

25.4. You may submit feedback, suggestions, or other contributions to us through various channels. All such feedback and contributions will be considered 'User Content' and are subject to the same licensing and usage terms as set forth in this Agreement.

25.5. You are solely responsible for all User Content that you post. The Service is not responsible for User Content, nor does it endorse any opinion contained in any User Content.

26. Refunds

26.1. Refunds, if issued, will be done on a case-by-case basis at the discretion of the Service.

26.2. Funds withdrawn by you or anyone else who has access to your account will not be refunded except in cases where it is proven, to our reasonable satisfaction, that the withdrawal resulted from unauthorized access or fraud for which you are not responsible.

26.3. The winner of an event will be determined on the date of the event's settlement, and we will not recognize protested or overturned decisions for wagering purposes.

26.4. All results posted shall be final after 72 hours and no queries will be entertained after that period of time.

26.5. If a match result is overturned for any reason by the governing body of the match within the payout period, then all money will be refunded.

26.6. Minimum and maximum wager amounts on all events will be determined by us and are subject to change without prior written notice.

26.7. Customers are solely responsible for their own Account transactions. Once a transaction is complete, it cannot be changed.

26.8. Company reserves the right to remove events, markets and any other products from the Website.

27. Communications, Notices, and Complaints

27.1. All communications and notices to be given under these Terms by you to us shall be sent using a Customer Support form on the Website or by email to support@blockchain.poker.

27.2. All communications and notices to be given under these Terms by us to you shall, unless otherwise specified in these Terms, be either posted on the Website and/or sent to the Registered Email Address we hold on our system for the relevant Customer.

27.3. All communications and notices to be given under these Terms by either you or us shall be in writing in the English language.

27.4. From time to time, we may contact you by email for the purpose of offering you information about betting, unique promotional offerings, and other information. You can choose to opt out of receiving such promotional offers from us at any time by submitting a request to Customer Support.

27.5. If you have any concerns or questions regarding these Terms, you should contact our Customer Service Department via the links on the Website.

27.6. Disputes must be lodged within three (3) days from the date the wager in question has been decided. No claims will be honoured after this period.

27.7. In the event of a dispute arising between you and us, our Customer Service Department will attempt to reach an agreed solution. Should our Customer Service Department be unable to reach an agreed solution with you, the matter will be escalated to our management.

27.8. Should all efforts to resolve a dispute to the Customer's satisfaction have failed, the Customer has the right to have the dispute settled via arbitration.

28. Miscellaneous

28.1. No waiver by Blockchain Poker, by conduct or otherwise, of any breach or threatened breach of any provision of this Agreement shall in any way be construed as a waiver of any subsequent breach of such provision or of any breach of any other provision of this Agreement. The failure of us to enforce at any time any term or condition of this Agreement shall not be construed to be a waiver of such provision or of the right of us to enforce such provision at any other time.
